1. Who We Are
OnBooq (ACN 690 973 285) is a revenue growth system that eliminates admin work for service businesses. We capture leads, automate bookings, and manage reviews so our clients can focus on delivering their services.
By using our services, you agree to these Terms and Conditions. These terms form a binding agreement between you (“Client”, “you”) and OnBooq Pty Ltd (“OnBooq”, “we”, “us”, “our”).
2. Services and Use
You agree to use OnBooq only for lawful business purposes. You are responsible for the accuracy of your business information, including service details, contact data, and communications sent through our systems.
We may modify, suspend, or discontinue parts of our service at any time where necessary for maintenance, system upgrades, or legal compliance.
3. Payments and Fees
All fees for OnBooq subscriptions or services are payable in advance according to your chosen plan. Payments made directly to OnBooq are processed securely through third-party gateways such as Stripe. OnBooq absorbs any associated transaction fees.
If you connect your own Stripe account to collect payments from your customers, Stripe’s standard transaction fees apply and are your responsibility. OnBooq does not control or modify fees charged by Stripe for transactions processed through your connected account.
Fees are non-refundable unless required by Australian Consumer Law. Failure to pay may result in suspension or termination of your services until payment is received.
Subscriptions renew automatically each billing cycle unless cancelled prior to the renewal date.
4. Cancellation Policy
You may cancel your service at any time by emailing [email protected]. Upon cancellation:
All OnBooq services, data automation, and integrations will be removed or deactivated shortly after your notice.
No refunds or partial credits will be issued for mid-month or unused portions of your billing cycle.
Access to your dashboards, reports, and customer data will lapse once cancellation takes effect.
There are no fixed-term contracts or lock-in periods. Services operate on a flexible, cancel-anytime basis.
We recommend exporting any data you wish to retain before cancellation is processed.
5. No Refund Policy
All payments are final once processed, except as required under Australian Consumer Law. If you cancel mid-month or partway through a billing cycle, your service remains active until the end of the paid period, but no refunds will be issued.
When termination takes effect, all associated data, integrations, and account materials will be permanently deleted from our systems.
6. Information We Collect
Our collection and use of personal information are also governed by our Privacy Policy
6.1 - Business Information
When you become a client, we collect your business name, address, contact details, service offerings, pricing,
business hours, availability, and payment details. We also collect staff names, roles, and schedules to manage your booking systems.6.2 - Customer Data We Process on Your Behalf
To deliver leads, bookings, and reviews, we process customer details such as names, phone numbers, emails, booking information, messages, and feedback. Payment information is handled securely through our payment partners.6.3 - Technical Information
We automatically collect usage data such as pages visited, browser type, IP address, and device information. Cookies and tracking pixels are used for functionality and analytics.
7. How We Use Information
7.1 - For Clients
We use your information to set up and manage lead capture, booking systems, automated follow-ups, and performance reporting. We also process payments and provide customer support.7.2 - For Your Customers
We use customer data to process bookings, send reminders, manage communications, and collect reviews. Payment data is handled by secure third-party processors.7.3 - For Business Operations
We analyse usage to improve performance and features, maintain security, and comply with legal obligations.
8. How We Share Information
8.1 - With Customers
We display your business details and facilitate communications between you and your customers. Reviews are published with customer consent.8.2 - With Service Providers
We use trusted partners for automation, hosting, analytics, communication, and payment processing. These providers are bound by strict confidentiality and data protection obligations.8.3 - Legal Requirements
We may disclose information if required by law or necessary to protect our rights, clients, or the public.8.4 - Business Transfers
If OnBooq undergoes sale, merger, or restructuring, your data may be transferred under equivalent privacy protections.
9. Data Security
All data transmission and storage are encrypted using industry-standard protocols. We maintain strict access controls, conduct regular security audits, and follow defined incident response procedures.
Secure backup systems ensure data integrity and recovery in the event of technical issues.
10. Your Rights
Under the Australian Privacy Principles, you have the right to access, correct, delete, or restrict use of your personal information. You may also request data portability or object to certain uses.

11. Data Retention
We retain client data for the duration of your service agreement plus seven years for business record-keeping. Customer data is retained as required by your operations and applicable law. Technical data is generally retained for two years unless required longer for compliance.
12. International Data Transfers
Some of our providers may operate outside Australia. When data is transferred internationally, we apply contractual and technical safeguards to maintain equivalent protection under Australian privacy law.
13. Cookies and Tracking
We use cookies to remember preferences, analyse performance, and personalise content. You can control cookies through your browser, but disabling them may reduce functionality.
14. Intellectual Property
All OnBooq software, branding, and materials remain our exclusive property. You may not copy, modify, or reverse-engineer any part of our system.
You retain ownership of your own business and customer data entered or generated through OnBooq.
15. Limitation of Liability
To the fullest extent permitted by law, OnBooq is not liable for any indirect or consequential loss, including loss of revenue, data, or business opportunity.
Our total liability for any claim arising from these terms will not exceed the total fees paid by you in the three months preceding the claim.
16. Indemnity
You agree to indemnify and hold harmless OnBooq, its employees, and affiliates from any claims or losses arising from your use of our services, your data, or your breach of these terms.
17. Service Availability
We strive to maintain continuous service but do not guarantee uninterrupted operation. We are not liable for outages caused by third-party systems, internet failures, or scheduled maintenance.
18. Marketing Communications
We may send updates, feature announcements, and promotions relevant to your business. You may unsubscribe at any time using the link in our emails or by contacting us.
19. Changes to These Terms
We may update these Terms and Conditions to reflect changes in services, technology, or legal requirements. Material updates will be notified by email or through your dashboard. The latest version is always available on our website.
20. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved under the exclusive jurisdiction of Australian courts.
21. Acceptance
By clicking “I Agree”, signing up, or continuing to use OnBooq’s services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you are agreeing on behalf of a business or organisation, you represent that you have authority to bind that entity to these terms.
